This Privacy Policy explains how Dermara Labs LLC, a Wyoming limited liability company doing business as Dermara ('Dermara,' 'we,' 'us,' or 'our'), collects, uses, shares, and protects information when you visit our website, place an order, contact us, or otherwise interact with our services. It applies to customers located in the United States.
1.Information We Collect
We collect information in three ways: information you provide directly, information collected automatically as you use the site, and information we receive from third parties who help us operate the business.
2.Personal Information You Provide
When you create an account, place an order, subscribe to marketing, contact support, or submit a review, you may provide: name, email address, phone number, shipping and billing address, order details, account credentials, product preferences, photos or videos submitted with support or warranty claims, and any content you choose to share with us. Please do not send us sensitive health or medical information.
3.Payment Information
Payments are processed by third-party payment processors (such as our storefront and card processing partners). When you pay, your card information is submitted directly to the payment processor. We do not store full payment card numbers on our servers. We receive limited information such as the last four digits, card brand, billing ZIP, and transaction status.
4.Information Collected Automatically
When you use our site, we and our service providers automatically collect certain information, including: IP address, device identifiers, browser type and version, operating system, referring URLs, pages viewed, links clicked, time spent, and general location inferred from IP address. This information helps us operate, secure, analyze, and improve the site.
5.Cookies and Similar Technologies
We use cookies, pixels, tags, and similar technologies to remember your preferences, keep you signed in, maintain your cart, measure site performance, and support marketing. You can control cookies through your browser settings; disabling certain cookies may affect site functionality.
6.Analytics
We use analytics providers, which may include Google Analytics, to understand how visitors use the site so we can improve it. These providers set their own cookies and collect information about your visits over time and across websites. You may opt out of Google Analytics using Google's opt-out tools.
7.Meta (Facebook & Instagram) Pixel
We use the Meta Pixel and related tools to measure the performance of our advertising, understand actions people take on our site (such as viewing a product or completing a purchase), and show relevant ads on Meta platforms. Meta receives certain information such as pages visited, actions taken, and hashed identifiers where applicable. You can manage ad preferences in your Facebook and Instagram account settings.
8.Storefront and Order Data
Our storefront platform processes account, order, cart, and checkout data on our behalf, including fraud-prevention signals. This data is used to operate the store, process orders, prevent fraud, and provide customer support.
9.Email Marketing
If you opt in, we may send marketing emails about products, promotions, and content we think you'll enjoy. Every marketing email includes an unsubscribe link. Unsubscribing does not affect transactional messages such as order confirmations, shipping updates, or support replies.
10.SMS Marketing
If SMS marketing is offered and you opt in, you consent to receive recurring automated marketing text messages at the number you provide. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to unsubscribe and HELP for assistance. We do not sell SMS opt-in information, and phone numbers collected for SMS marketing are not shared with third parties for their own marketing purposes.
11.How We Use Information
We use information to: process orders and payments; deliver products; provide customer support; operate, maintain, and improve the site; personalize your experience; send transactional and, where permitted, marketing communications; detect, prevent, and investigate fraud, abuse, and security incidents; comply with legal obligations; and enforce our Terms of Use and other policies.
12.How We Share Information
We share information only as needed to operate the business, including with: (a) service providers that host our site, process payments, ship orders, send messages, provide analytics or advertising measurement, and support fraud prevention; (b) professional advisors such as lawyers and accountants; (c) authorities when required by law, subpoena, or to protect rights, safety, or property; and (d) parties involved in a merger, acquisition, financing, or similar transaction, subject to appropriate confidentiality. We do not sell personal information for money. Certain sharing for cross-context behavioral advertising (such as Meta Pixel activity) may be considered a 'sale' or 'sharing' under some U.S. state laws; see 'Your Privacy Rights' below.
13.Third-Party Providers
Our third-party providers process information under their own privacy practices for the limited purposes of providing services to Dermara. We select providers that offer reasonable security and data-processing terms, but we do not control their independent practices.
14.Security
We use administrative, technical, and organizational safeguards designed to protect information, including encryption in transit and access controls on our systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please protect your account credentials and notify us promptly of any suspected unauthorized use.
15.Data Retention
We retain information for as long as needed to provide the Services, comply with legal, tax, and accounting obligations, resolve disputes, prevent fraud, and enforce our agreements. Retention periods vary based on the type of data and the purpose for which it was collected.
16.Children's Privacy
The Services are not directed to children under 16, and we do not knowingly collect personal information from children under 16. If we learn we have collected such information, we will delete it. Parents or guardians who believe a child has provided information should contact legal@dermara.beauty.
17.Your Privacy Rights
Depending on your state of residence, you may have rights to: (a) know or access the personal information we hold about you; (b) request correction of inaccurate information; (c) request deletion; (d) opt out of certain 'sales' or 'sharing' of personal information, or targeted advertising; and (e) not be discriminated against for exercising your rights. To exercise your rights, email legal@dermara.beauty with the subject line 'Privacy Request.' We will verify your request using reasonable methods before responding.
18.California Residents
California residents have additional rights under the California Consumer Privacy Act (as amended). These include the rights described above, plus the right to designate an authorized agent. To submit a request or a Global Privacy Control opt-out signal, contact legal@dermara.beauty.
19.Do Not Track
Our site does not currently respond to 'Do Not Track' browser signals. We honor recognized opt-out signals such as Global Privacy Control where required by applicable law.
20.International Visitors
Our Services are intended for customers in the United States. If you access the Services from outside the U.S., you understand that your information may be processed in the United States, where privacy laws may differ from those of your jurisdiction.
21.Changes to This Policy
We may update this Privacy Policy from time to time. The 'Last updated' date at the top reflects the most recent revision. Continued use of the Services after an update means you accept the revised policy.
