By visiting, browsing, creating an account, or purchasing from Dermara, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Return & Refund Policy, and Limited Warranty Policy, each of which is incorporated by reference. We may revise these Terms at any time; the version posted on this site at the time of your visit or order applies to that interaction.

The Services are intended for users who are at least 18 years of age (or the age of majority in their jurisdiction) and located in the United States. By using the Services, you represent that you meet these requirements and that all information you provide is accurate, current, and complete.

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms, appear fraudulent, or are used to abuse promotions, returns, or warranties.

We strive to describe our products accurately, including features, ingredients, images, and intended cosmetic use. However, we do not warrant that product descriptions, colors, imagery, or other content on the Services are complete, accurate, reliable, current, or error-free. Dermara products are cosmetic and wellness devices and are not intended to diagnose, treat, cure, or prevent any disease. Individual results vary and are not guaranteed.

All prices are displayed in U.S. dollars and are exclusive of applicable taxes, duties, and shipping fees unless expressly stated. Prices may change without notice. In the event of an obvious pricing error, we reserve the right to cancel or refuse any order placed at the incorrect price, whether or not the order has been confirmed and your payment method charged.

You authorize us and our payment processors to charge your selected payment method for the total order amount, including taxes and shipping. You represent that you are the authorized user of the payment method and that the information provided is true and correct. We do not store full payment card numbers on our servers.

Promotional codes, discounts, and offers are limited-time, non-transferable, non-cumulative unless explicitly stated, and may be revoked at any time. Codes have no cash value, cannot be applied retroactively, and may not be combined with other offers. We reserve the right to modify or cancel any promotion, and to disqualify participants who we reasonably believe are abusing, manipulating, or acting in bad faith with respect to any offer.

Your submission of an order constitutes an offer to purchase; our acceptance occurs only when the order is shipped. Until then, we may, in our sole discretion, refuse, limit, cancel, or require additional verification for any order for any lawful reason, including but not limited to: suspected fraud, resale, unauthorized reshipment, pricing errors, inventory limitations, shipping restrictions, prior violations of these Terms, or failure to pass identity, address, or payment-method verification.

Shipping timelines shown on the Services are good-faith estimates only and are not guaranteed. Actual transit times depend on the carrier, customs, weather, and other factors outside our control. Title and risk of loss pass to you upon our delivery of the products to the carrier. We are not liable for delays, damage, or loss that occurs after transfer to the carrier, except as expressly required by law or as covered by our Return & Refund Policy for verified lost or damaged shipments.

All content on the Services — including the Dermara name, logo, product designs, device shapes, packaging, imagery, text, video, audio, graphics, user interfaces, and underlying code — is the property of Dermara or its licensors and is protected by U.S. and international copyright, trademark, trade dress, patent, and other intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to view and use the Services for personal, non-commercial purposes only. No other rights are granted, and any unauthorized use is strictly prohibited.

If you submit reviews, photos, videos, testimonials, comments, or other content ('User Content') through the Services or associated social channels tagging Dermara, you grant Dermara a perpetual, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in any media, in connection with our business, without further notice, attribution, or compensation. You represent that you own or control all rights to the User Content and that it does not violate any third-party rights or applicable laws.

You agree not to: (a) use the Services in violation of any law; (b) attempt to gain unauthorized access to any portion of the Services; (c) scrape, harvest, or use automated means to access the Services; (d) resell or redistribute our products without written authorization; (e) submit false, misleading, or fraudulent information; (f) abuse promotions, returns, refunds, or warranty claims; (g) upload malicious code; (h) impersonate any person or entity; or (i) interfere with the operation of the Services or another user's enjoyment of them.

The Services may contain links to, integrations with, or embeds of third-party websites, tools, and services (including payment processors, analytics providers, and social platforms). We do not control and are not responsible for the content, policies, or practices of any third party. Your interactions with third parties are solely between you and that third party.

Except for the express Limited Warranty provided with our devices, the Services and all products are provided on an 'AS IS' and 'AS AVAILABLE' basis. To the maximum extent permitted by law, Dermara disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any defects will be corrected. No advice or information obtained from Dermara creates any warranty not expressly stated in these Terms.

To the maximum extent permitted by law, in no event shall Dermara, its affiliates, officers, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising from or related to your use of the Services or products, even if advised of the possibility of such damages. Dermara's total aggregate liability for any claim relating to the Services or any product shall not exceed the amount you paid to Dermara for the product giving rise to the claim in the six (6) months preceding the event. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

You agree to indemnify, defend, and hold harmless Dermara and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use or misuse of the Services or products; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any law or third-party right.

Dermara shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, government actions, labor disputes, carrier delays, supply-chain disruptions, pandemics, epidemics, or interruptions of utilities, networks, or services.

These Terms and any dispute arising from your use of the Services are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. Subject to the arbitration provisions below, the state and federal courts located in Laramie County, Wyoming shall have exclusive jurisdiction over any dispute not subject to arbitration.

The parties will attempt to resolve any dispute informally by contacting legal@dermara.beauty before initiating any formal proceeding. If the dispute cannot be resolved within sixty (60) days, both parties agree that all disputes, claims, or controversies arising out of or relating to these Terms, the Services, or any product — whether in contract, tort, statute, or otherwise — shall be resolved exclusively by final and binding individual arbitration, and not in court, under the Consumer Arbitration Rules of the American Arbitration Association. The arbitration shall take place in Laramie County, Wyoming, or by videoconference where permitted. YOU AND DERMARA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights, and either party may bring an individual claim in small-claims court.

If any provision of these Terms is held to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, Return & Refund Policy, and Limited Warranty Policy, constitute the entire agreement between you and Dermara concerning the Services and supersede any prior agreements on the same subject.
